NEW YORK (Reuters) - A federal judge in California entered a directed verdict Tuesday in favor of the top two U.S. cigarette makers in a suit brought by the family of a deceased smoker, saying the plaintiffs did not bring enough evidence to back their claims that Philip Morris and R.J. Reynolds were responsible for the smoker's death.

As much as I hate the tobacco companies, this is the absolute right verdict. The smoker is responsible for his own fate, not the tobacco companies. About time we got a sensible ruling from these insane lawsuits.

As much as I hate the tobacco companies, this is the absolute right verdict. The smoker is responsible for his own fate, not the tobacco companies. About time we got a sensible ruling from these insane lawsuits. I'm not a smoker (never have been) but as long as tobacco products are LEGAL, I don't see why any of these cases have merit at all.
Even IF the guy smoked for 60 years (assuming he started at 20) once all the warnings were put out and printed on every pack starting somewhere around 1965, anyone who continued to smoke did so at their own "risk." I put "risk" in quotes because the scientific evidence for/against smoking is all politically based anyway.
The reality is, the government will never "ban" or "outlaw" smoking because they want the tax revenues from it. All these lawsuits are BS IMO....

who died in 1999 at the age of 81 She was blessed to live this long. Maybe a case could be made that tobacco lenghtened her life, since she lived longer than the average person.

This is one of the most ridiculous lawsuits I have ever heard about. The man was 81 years old and his smoking killed him? Maybe the smoking is what kept him alive so long,a ridiculous statement I know,but no more ridiculous than claiming smoking killed him.
Maybe we can get some lawyers to try to prove that smoking was good for him. It seems lawyers will do anything to make a buck.
What a ridiculous country this has become.

How about this! The judge couldn't find clear-cut proof that smoking actually killed this person. Finally, a clear-headed judge! This person's lifestyle killed him! Not just smoking. Was he obese? Was he an alcoholic? Did he dabble in drugs? Lots of things can add up to death. Just because a person smokes doesn't mean it's gonna kill him!

he was somewhere crying because he had ordered a new mercedes and a 50 ft cabin cruiser and wrote a hot check of for both....now he has to take them back even before they are delivered. p.s. his wife ran off with the pizza delivery guy too, because at least he has a steady job and knows he will still be driving that same 20 year old Datsun next week that he is driving this week!!!

For any of us that are alive today it is just a matter of time until that will no longer be true. Well, life is terminal. No one gets out of here alive. And with the nuclear idiots running around, makes me wonder just how long any of us actually have. Smoking should be the least of our worries.
